4. Enquiries and Bookings
Submitting an enquiry through our website does not constitute a confirmed booking or create an obligation to purchase services.
A booking will be confirmed in accordance with the acceptance requirements specified in the relevant quotation, proposal or service agreement.
Depending on the project, confirmation may require written acceptance, payment of a deposit or completion of other agreed booking requirements.
Clients are responsible for providing accurate project information, including event dates, venues, deliverables, access requirements and any relevant production restrictions.
HDR Media Solutions reserves the right to decline a proposed engagement, subject to applicable law and any existing contractual obligations.
5. Quotations and Pricing
Project pricing will be communicated through quotations, proposals or written agreements.
Unless otherwise specified:
- Prices are quoted in South African rand (ZAR).
- Quotations are valid for the period stated in the quotation.
- VAT will be identified where applicable.
- Travel, accommodation, permits, additional crew, equipment hire, overtime and third-party expenses will be addressed in the quotation where relevant.
- Changes to the agreed project scope may require revised pricing and written approval.
Any additional charges must be communicated and agreed where required by the applicable agreement or law.
A quotation should clearly identify the agreed services, deliverables, payment arrangements and any important exclusions.
6. Payments
Payment terms, deposits, instalments and final payment deadlines will be specified in the applicable quotation or service agreement.
Clients agree to pay amounts properly due under the agreed terms.
Where lawful and contractually agreed, failure to make a required payment may result in work being paused, delivery being delayed or a booking being cancelled after appropriate notice and subject to applicable law.
Any interest, collection costs or other late-payment charges must be lawfully recoverable and properly disclosed where required.
Nothing in this section permits HDR Media Solutions to disregard applicable consumer rights or contractual obligations.
7. Cancellations and Rescheduling
Clients wishing to cancel or reschedule a confirmed booking should notify HDR Media Solutions in writing as soon as reasonably possible.
The cancellation terms applicable to a project will be set out in the relevant quotation or service agreement.
Where permitted by law, cancellation charges may reflect work already completed, reasonable costs incurred, non-refundable third-party commitments and other properly disclosed contractual charges.
Refunds and cancellation rights will be determined in accordance with the applicable agreement and South African law, including the Consumer Protection Act 68 of 2008 where it applies.
Nothing in these terms automatically makes every deposit non-refundable or removes a consumer's statutory right to cancel where such a right exists.
8. Project Scope, Delivery and Revisions
The scope of work, deliverables, formats, revision allowance and expected delivery dates will be agreed in writing.
Requests that fall outside the agreed scope may require additional fees, subject to appropriate agreement.
Clients are expected to provide feedback, approvals, access and materials within agreed timeframes.
Delays caused by late approvals, incomplete information, venue restrictions, adverse weather, technical failures or other circumstances may affect delivery schedules.
HDR Media Solutions will take reasonable steps to communicate material delays and discuss appropriate alternatives.
Unless expressly included in the agreement, unedited footage, original project files, additional photographs, unused material and working files are not automatically included in the final deliverables.
9. Copyright and Intellectual Property
Intellectual property rights in photographs, videos, edits, graphics, creative concepts and other original materials produced by HDR Media Solutions will be governed by applicable South African law and the relevant project agreement.
Unless otherwise agreed in writing, paying for a project does not automatically transfer ownership of all intellectual property rights to the client.
The client receives only the licence or rights expressly granted in the applicable agreement.
Clients may not reproduce, resell, sublicense, distribute or commercially exploit materials beyond the agreed permissions without the necessary authorisation.
Third-party materials, including music, stock footage, fonts and licensed assets, remain subject to their respective licence conditions.
Clients retain their rights in materials they supply to HDR Media Solutions and must ensure that they have the necessary rights and permissions for the intended use of those materials.
All intellectual property arrangements remain subject to applicable copyright legislation and any rights that cannot lawfully be excluded.
10. Portfolio and Promotional Use
HDR Media Solutions may showcase completed work on its website, social media channels, showreels, proposals and other promotional materials only where the necessary permission has been obtained.
Permission may be recorded in a project agreement, release form or separate written authorisation.
Clients should communicate confidentiality requirements, publication embargoes and restrictions on promotional use before the relevant material is published.
Any use of identifiable individuals, confidential material or third-party intellectual property must comply with applicable permissions and legal requirements.
11. Client Responsibilities
Clients agree to:
- Provide accurate project information.
- Obtain permissions and access approvals allocated to them under the project agreement.
- Ensure they have the necessary rights to materials supplied to us.
- Cooperate reasonably during production.
- Communicate relevant venue rules, safety requirements and restrictions.
- Review and approve deliverables within agreed timeframes.
HDR Media Solutions remains responsible for its own legal obligations and for obtaining any permissions specifically allocated to it under the applicable agreement.
12. Drone Services and Live Streaming
Drone operations and live-streaming services are subject to applicable laws, permissions, weather conditions, venue restrictions, connectivity and technical limitations.
HDR Media Solutions will undertake drone operations in accordance with applicable aviation requirements and permissions.
Live streaming may depend on internet connectivity, third-party platforms, power availability, venue infrastructure and other factors outside our reasonable control.
We will take reasonable steps to plan and deliver these services in accordance with the agreed scope. However, uninterrupted streaming, platform availability and operation in unsuitable weather or prohibited airspace cannot be guaranteed.
Where a material technical or operational issue arises, we will take reasonable steps to communicate the issue and discuss practical alternatives.
13. Website Use
You agree to use our website lawfully and responsibly.
You must not:
- Use the website for fraudulent, unlawful or misleading purposes.

We may take reasonable steps to protect our website and business against misuse, subject to applicable law.
14. Website Availability and Third-Party Links
We aim to keep our website accessible and its content reasonably accurate. However, we do not guarantee that the website will always be available, uninterrupted or free of errors.
We may update or modify website content and functionality from time to time.
Our website may contain links to third-party websites or platforms. These are provided for convenience, and their content, availability and practices are not necessarily controlled by HDR Media Solutions.
This section does not limit any obligation arising under an existing agreement or applicable law.
15. Privacy Policy
Our Privacy Policy is a separate document that explains how HDR Media Solutions handles personal information in connection with the website and our services.
The Privacy Policy should be read alongside these Terms of Service.
For privacy-related enquiries, please use the contact details provided in our Privacy Policy.
16. Limitation of Liability
Nothing in these terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.
To the extent legally permissible, HDR Media Solutions will not be liable for indirect or consequential losses where a valid exclusion applies.
Any limitation of liability for a particular project must be interpreted in accordance with the relevant agreement and applicable law.
Marketing, advertising and social media services do not guarantee particular sales, audience numbers, engagement levels or commercial outcomes. Results may depend on factors including market conditions, advertising budgets, platform algorithms and client participation.
This does not remove any responsibility for failure to meet applicable contractual or statutory obligations.
17. Circumstances Beyond Our Reasonable Control
Neither party will be responsible for a delay or failure to perform to the extent that it results from circumstances beyond its reasonable control, including severe weather, natural disasters, public emergencies, government restrictions, venue closures or widespread infrastructure failures.
The affected party should notify the other party as soon as reasonably practicable and take reasonable steps to minimise the impact.
Any resulting rescheduling, alternative delivery arrangements, refunds or termination rights will be determined by the applicable agreement and South African law.
18. Complaints and Dispute Resolution
We encourage clients to raise concerns directly with HDR Media Solutions in writing so that we can attempt to resolve them fairly and promptly.
If a dispute cannot be resolved informally, the parties may consider mediation or an appropriate court, tribunal or consumer-protection body.
Nothing in this section prevents a person from exercising a statutory right or approaching a competent regulator or dispute-resolution body.
19. Governing Law
These Terms of Service are governed by the laws of the Republic of South Africa.
Any dispute will be handled by a court or tribunal with the appropriate jurisdiction, subject to applicable consumer-protection laws and the rights of the parties.
20. Changes to These Terms
HDR Media Solutions may update these Terms of Service when reasonably necessary to reflect changes to our services, website or legal obligations.
The latest version will be published on our website with its effective date.
Updates to these website terms do not automatically amend an existing signed agreement or retrospectively remove rights that have already accrued.
21. Severability
If any provision of these terms is found to be unlawful or unenforceable, it will be interpreted or severed to the minimum extent necessary where legally permissible.
The remaining provisions will continue to apply to the extent that they remain lawful and enforceable.
